{"id":6626,"date":"2015-06-27T10:21:33","date_gmt":"2015-06-27T14:21:33","guid":{"rendered":"http:\/\/www.thevalleyledger.com\/?p=6626"},"modified":"2015-06-27T10:27:45","modified_gmt":"2015-06-27T14:27:45","slug":"u-s-supreme-court-rules-same-sex-marriage-is-legal-in-all-50-states-bryantukartslaw","status":"publish","type":"post","link":"https:\/\/thevalleyledger.com\/?p=6626","title":{"rendered":"U.S. Supreme Court Rules Same Sex Marriage is Legal in All 50 States &#8211; @BryanTukArtsLaw"},"content":{"rendered":"<p>For watchers of the US Supreme Court, or for politically minded people, same sex marriage has been a hot button issue.\u00a0 Marriage equality, or same sex marriage, has been one of the key battles in the culture wars between conservatives and liberals.<\/p>\n<p>The last decade has seen many state legislatures and also the US Congress adopt \u201cdefense of marriage\u201d statutes, in which the legal definition of marriage was a marriage or union between one woman and one man.\u00a0 Those laws have been contested in court for years and years, and we now are at the end of all of those legal battles.<\/p>\n<p>The culture war is over.\u00a0 The Supreme Court ruled today that it is unconstitutional for any state governments to deny same sex couples marriage licenses.<\/p>\n<p>Today the US Supreme Court ruled in the case of<em> Obergefell v. Hodges <\/em>that the States must\u00a0 issue marriage licenses to same sex couples who apply for them, and that the States must recognize a marriage between two people of the same sex when their marriage was lawfully licensed and performed out-of-State.\u00a0 This ruling was not unanimous, it was decided by a 5-4 margin.<\/p>\n<p>So what does this mean for us in our daily lives?\u00a0 The answer is quite a lot.\u00a0 While much of the journalism out there has focused heavily on the symbolism of the wedding ceremony, there are many other facets of people\u2019s legal rights that will be affected.<\/p>\n<p>Married same sex couples <em>can now get prenuptial agreements<\/em> that have some legal significance.<\/p>\n<p>Married same sex couples <em>can now treat one another as spouses in their wills<\/em>.\u00a0 Before today\u2019s ruling, this was legally not possible.\u00a0 If there is no will, the intestacy statues in Pennsylvania and all other states determine how a decedent\u2019s property passes to the survivors.\u00a0 As you can imagine, the surviving spouse is given preferential treatment on some of those issues.\u00a0 The Court\u2019s ruling should grant surviving same sex spouses that same preferential treatment.<\/p>\n<p>Any barriers based in state law that would have the effect of making it more difficult for married <em>same sex couples to adopt children now<\/em> will have to be repealed.<\/p>\n<p>Inevitably, some <em>married same sex couples will eventually divorce<\/em>.\u00a0 The Divorce Code in Pennsylvania is has a lot of assumptions built into about the \u201ctraditional\u201d roles of men and women in marriage.\u00a0 This is particularly true in the sections that detail the parties\u2019 obligations with respect to alimony and child support.<\/p>\n<p>Another area that will be tremendously significant for same sex couples is the tax code. \u00a0The IRS will have to amend its forms to provide for the fact that <em>married same sex couples can file joint tax returns, and take the same tax deductions that heterosexual married couples have taken for years<\/em>.<\/p>\n<p>The Court\u2019s decision in this case is going to be felt for years, in many ways that we can\u2019t anticipate today.<\/p>\n<p><em>Bryan Tuk is an attorney focused on business law, family law &amp; nonprofits and arts organization law.\u00a0 To learn more, visit <\/em><a href=\"http:\/\/tuklaw.com\/\" target=\"_blank\"><em>http:\/\/tuklaw.com<\/em><\/a><em> and you can follow him on Twitter <\/em><a href=\"https:\/\/twitter.com\/BryanTukArtsLaw\" target=\"_blank\"><em>@BryanTukArtsLaw<\/em><\/a><em>.<\/em><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>For watchers of the US Supreme Court, or for politically minded people, same sex marriage has been a hot button issue.\u00a0 Marriage equality, or same sex marriage, has been one of the key battles in the culture wars between conservatives and liberals.
